1) This instruction was elaborated to clarify the procedure for re-delegation of a private second-level domain name in the .UA domain at registrant’s sole discretion in accordance with the Law of Ukraine “On Protection of Rights to Marks for Goods and Services”, Madrid Agreement Concerning the International Registration of Marks, Protocol to the Madrid Agreement.
2) Re-assignment of the private domain name to another registrant shall be carried out at the registrant’s own request, stated in writing and sent to the current registrar, i.e. based on the written application of the domain name registrant (sample is provided in Annex N1 to this Instructions) and application of the future registrant for acceptance of the relevant domain name (sample is provided in Annex N2 to this Instructions).
3) Duly certified copies of the following documents shall be attached to the applications:
3.1) When transferring the exclusive rights to the trademark (hereinafter referred to as the Mark):
A copy of the decision of the State Department of Intellectual Property on the transfer of ownership of a mark protected by a certificate of Ukraine and/or an extract from the State Register of Ukraine Certificates for a mark. If only one extract is provided, it shall be accompanied by a copy of the last page (with the signatures of the parties) of the agreement on the transfer of the rights to the Mark and the stamp of the State Department of Intellectual Property);
Or:
copy of the duplicate certificate of Ukraine issued in the name of the new owner of the Mark.
3.2) When transferring the rights to a mark that has protection on the territory of Ukraine in accordance with international treaties, an official document on the validity of the international registration on the territory of Ukraine, with a copy of the bibliographic data of the corresponding registration, is added to the applications.
3.3) When concluding a license agreement for the right to use the Mark (license issuance), a copy of the decision of the State Intellectual Property Department on registration of the license agreement and a copy of the license agreement or an extract from the license agreement stating the transfer of the right to use the corresponding domain name shall be attached to the application.
3.4) If the domain name is registered in the name of a legal entity, to transfer the rights / transfer you must send a letter on the letterhead of the organization, with the seal of the organization and the signature of the head.
If the domain name is registered in the name of a natural person, copies of the first and second pages of the registrant’s passport must be submitted along with the application for transferring rights / transfer.
4) Applications may be signed by any person (representative) who acts under power of attorney, both the registrant and the prospective registrant. In this case, the application must be accompanied by a power of attorney (powers of attorney) executed in accordance with the requirements of applicable law.
5) The domain name is not re-delegated:
in the absence of a clause in the license agreement on the transfer of the right to use the relevant domain name.
